Terms of use of the Billit service
By clicking the option “I agree to the terms of use of the service”, which appears during the process of assigning the subscription plan and at your initial registration for the service, you declare that you agree to the terms set out in detail below (hereinafter “the Agreement”), which govern your use, as the Authorized User / Subscriber, of the online service “Billit” (hereinafter “the Service”), as provided by the company “Billit O.E.” to Authorized Users / Subscribers via the web address https://app.billit.io
The Service includes: use of the software packages of the Billit service, as well as the transfer and storage of data. If you enter into this Agreement as a representative of a legal entity, you must be authorized, generally or specifically, to bind the legal entity to the terms of this Agreement. In such a case, the term “Authorized User” or “Subscriber” refers to that legal entity. If you do not have the above authorization, or if you do not agree with the terms below, you may not access or use the Service.
1. Definitions
- Activation (Registration) Date means the date on which the Subscriber completes the ordering process and gains access to the Service.
- Company or Subscriber is the legal entity whose data is stored and processed by the company’s Operators through the Service.
- Operators are the natural persons (employee, agent, consultant) who have been authorized to use the Service through their security credentials (‘user names’ and ‘passwords’) that the company has obtained from Billit O.E.
- Subscription Term and Subscription Renewal: these are the concepts described in Article 3 of this Agreement.
- Subscriber Data means the data and other electronic files that have been entered, within the Service, for processing in the Subscriber’s database.
- ‘Frozen’ is the subscription plan in which the customer can only view what they have created. It usually arises when a subscription is not paid, and it remains active in this state for one (1) month. Thereafter, access is discontinued, and after 4 months it is permanently deleted together with all the data.
2. Grant of Right of Use
Subject to the terms of this Agreement, Billit O.E. grants the Subscriber a limited, non-exclusive, non-transferable and non-sublicensable right of use to access and use the Service exclusively by the Subscriber.
The Subscriber’s access to and use of the Service are also subject to the following additional terms:
- The Subscriber will receive an account code and a password for each account it creates and will be able to access the Service only through its email address and password.
- The right of use granted belongs exclusively to the Subscriber, in the sense that access by any third party without the Subscriber’s permission is prohibited.
- The Subscriber may change its details only by means of its user name and password. The Subscriber is solely responsible for protecting the credentials granted to it and is also solely responsible for any actions performed using its credentials, unless the credentials are leaked due to negligence on the part of Billit O.E. The Subscriber agrees to notify Billit O.E. immediately of any unauthorized use of its account or if it becomes aware of any security problem.
3. Subscription Term
This Agreement takes effect on its Effective Date (Activation - Registration date). The initial term of the Agreement will be the number of months specified through the online subscription ordering process (hereinafter the ‘Subscription Term’). If the Service is used as a Free Trial, access to the Service depends solely on Billit O.E. Shortly before the end of the Subscription Term or of the Renewal Term, the Subscriber must renew its subscription. If the renewed subscription is not paid within the specified deadline, this Agreement will be terminated and the Subscriber’s ability to access the Service will be discontinued automatically and without any obligation to give specific notice.
Billit O.E. undertakes to inform the Subscriber in good time of the upcoming end of the Subscription Term, via the email address that the Subscriber provided when registering for the Service.
The subscription is deactivated only if the Subscriber requests it from within their account.
4. Payment
For the services of the ‘Billit’ subscription to be provided, its total value must be paid within 10 calendar days from the activation (registration) date of the Service. Payment can be made either by credit card charge or by deposit to a bank account.
The subscription is activated immediately upon registration, regardless of the payment method.
If payment is not made, a warning message is sent to the Subscriber by email and the plan is automatically converted to ‘Frozen’.
5. Obligations of the Subscriber
The Subscriber agrees to use the Service only for lawful use in accordance with applicable law.
6. Intellectual property rights
The Service is protected by the applicable intellectual property laws and the corresponding provisions of international treaties. In this respect, as between the Subscriber and Billit O.E., Billit O.E. declares that it has no right over the Subscriber Data, and the Subscriber expressly acknowledges, accepts and agrees that Billit O.E. has the exclusive right to all financial and other benefits arising from this Service, the technology and software that make up the Service, and all elements that have been incorporated into the Service, except for the Subscriber Data entered and/or kept through the Service, as well as to all intellectual property rights collectively referred to as Billit O.E. Technology; in any event, the Subscriber expressly and unreservedly waives all of the above rights.
The Subscriber acknowledges and accepts that the installation of the software on its computer, as well as the use of the Service, does not mean a transfer to the Subscriber of ownership of the Billit O.E. Technology or of the commercial rights of any kind arising from it, and that the Subscriber acquires no right relating to this technology other than those set out in this Agreement and, in any event, expressly waives any such right.
7. Restrictions
The Subscriber acknowledges that it does not have the right:
- To grant, sublicense or directly or indirectly transfer, with or without consideration, access to and/or use of the Service to any third party,
- To allow a subsidiary, parent or otherwise affiliated company, or any third legal or natural person, to benefit from the use or the functionality of the Service, whether directly or in any indirect way,
- To transfer in any way to third parties the rights arising from this contract.
- To modify or create derivative works based on the Service, in whole or in part.
- To copy, make copies of, or delete trademarks of Billit O.E. or of the Billit service.
- To develop a product that competes with the Service and incorporates graphics, capabilities or functions of the Service.
All other rights not mentioned in this Agreement remain the exclusive property of Billit O.E. Billit O.E. reserves the right to carry out audits periodically, after prior written notice, in order to verify the Subscriber’s compliance with the terms of this Agreement.
8. Warranty
Billit O.E. represents and warrants that the Service will be provided in a professional manner in accordance with industry standards and that the Service will conform to its online description and the corresponding documentation found on its website.
Billit O.E., its suppliers and anyone else involved in providing the Service give no warranties and offer no remedies (corrective actions), nor do they assume any legal liability towards the Subscriber using the Service. The Service and the related materials are provided “as is”. Billit O.E. does not warrant that the software is free of any logical or technical error or free of other problems, or that it will meet the particular requirements of the Subscriber.
To the maximum extent permitted by law, Billit O.E. disclaims all liability that may relate to warranties and conditions, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose and non-infringement of third-party rights. The authorized representatives of Billit O.E. software products are associated with it only in the capacity of reseller or consultant and are not its subsidiaries, agents or employees.
9. Limitation of liability
In any event, the total liability of Billit O.E. towards the Subscriber will not exceed the amount of the fees paid to Billit O.E. for the use of the Service during the immediately preceding twelve-month period of use (in the case of annual prepayment) or the current month (in the case of a monthly subscription) from the date on which the claim for compensation is made. In no event will either of the contracting parties, or any party associated with the Service, be held liable for any damage arising indirectly or directly from the use of the Service (loss of data, revenue, profits or other financial benefits), regardless of the cause of the damage.
Billit O.E. assumes no obligation whatsoever for any loss of data, accidental disclosure, corruption or deletion of the content of the Subscriber Data, or any other form of harm or damage suffered as a result of the use of the Service. In that case, the Subscriber’s only right will be to terminate this Agreement.
10. Indemnification
The Subscriber agrees to indemnify and hold harmless Billit O.E. against claims arising from or relating to (1) breach of the terms of the Agreement, (2) the use of the Service by the Subscriber, (3) any goods or services sold or advertised in connection with the Subscriber’s use of the Services, (4) any defamatory or unlawful material included in the Subscriber Data, (5) any claim or demand by a third party concerning the Subscriber Data, relating to infringement of intellectual property or other rights, personal data or publicity.
Billit O.E. will defend, indemnify and hold harmless the Subscriber from and against any claims and liabilities relating to or arising from actions of third parties against the Subscriber due to infringement of intellectual property rights on the part of Billit O.E., on the strict condition that the Subscriber (1) promptly informs Billit O.E. of the relevant claims or demands, (2) provides Billit O.E. with the necessary information and the necessary support for its defense against the claim or demand, (3) grants Billit O.E. sole control of the handling of its defense against any such claim or demand, (4) has not already settled or satisfied that claim or demand.
11. Data storage
There is no limit beyond which the Subscriber will be charged for the storage space taken up by its data. However, Billit O.E. reserves the right to amend this policy at its absolute discretion.
12. Service Level Agreement
General:
This Agreement covers the minimum service level of the Service provided to the Subscriber and of any supplementary services described in detail in the Registration Form. The description of the Service will be amended periodically on the basis of newer versions of the software. It is the Subscriber’s responsibility to keep track of the description (capabilities) of the Service. The Subscriber should report any differences between the description of the Service and the Service itself as soon as possible. Billit O.E. will make every effort to ensure availability of the Service of 99% (average per month). The Subscriber agrees to use the Service in accordance with the other terms of this Agreement. The terms of the Agreement may change periodically and Billit O.E. will take care to inform the Subscriber accordingly, which does not release the Subscriber from the obligation to keep regularly informed of the terms of the Agreement in force.
Billit O.E. will make every effort to keep the Service accessible over the Internet. Because the Service is provided over the Internet and is therefore subject to limitations, delays and other problems directly related to the operation of the Internet and electronic communications, Billit O.E. is not responsible for any delays, delivery problems or other damage that may result from such problems. The Service may be interrupted for scheduled maintenance work. Billit O.E. will make every effort to keep such interruptions to a minimum and to carry out scheduled maintenance work at times of low demand.
12.1. Security
The Subscriber’s data belongs exclusively to the Subscriber. Billit O.E. undertakes not to use the Subscriber’s data (records) except to the extent necessary to make backup copies, and not to make it available or disclose it to any third party. Billit O.E. ensures the protection of the Subscriber’s data using appropriate data protection practices, such as protection of security credentials and ‘data encryption’. With regard to data security, Billit O.E. undertakes to make regular, scheduled backup copies. The Subscriber’s data is stored in ‘MYSQL Server’ databases. The system components, where technically feasible, are redundant (more than would be indicated for comparable applications), with the aim of ensuring, as far as possible, the uninterrupted operation of the Service.
12.2. Provision of Support Services
Billit O.E. also provides the Subscriber with support services. It is clarified that support services are provided in order to restore the level of operation of the installation to the form it had before the problem arose. They also include providing clarifications about the services and receiving reports of any problems or faults relating to the Service.
These services, depending on the case, are either built into the Service or provided under a separate contract.
Telephone Support is not provided with any type of subscription. The current method for technical support requests is called ‘Email Ticket’; it carries no extra charge, and the Subscriber simply sends their request by email to the support address and will receive a reply within 48 hours.
Billit O.E. will make every effort to remedy faults or problems relating to the Service as promptly as possible. If the Service cannot be used through the fault of Billit O.E. due to a complete system failure, the Subscriber will be informed by any means possible.
12.3. Training Service
For training in the use of the applications of the Service, resolving questions about their use, making better use of their capabilities and guidance in completing procedures, Billit O.E. makes various training tools available to the Subscriber, which can be used remotely and at any time.
Classroom training is provided, at an additional charge, by Billit O.E., its partners and partner training organizations.
12.4. Service Availability
The target is availability of the Service at least 99% of the time, measured as an average per month, excluding scheduled interruptions for maintenance. In addition, it is estimated that the part of the Service that depends on Billit O.E. will be continuously available except for three unscheduled interruptions, each with an estimated duration of 2 hours. Billit O.E. will make every effort to give notice of any known and confirmed interruptions in the provision of the Service caused by other factors, and also to give notice as soon as the availability of the Service is restored.
Scheduled interruptions in the provision of the Service will not exceed 4 hours every fortnight and will take place at times of low demand. The Subscriber will be informed accordingly of scheduled interruptions.
13. Personal data protection (privacy)
We use your personal data for the following main purposes:
- To provide an account code and password for the free trial use of certain services
- To give you access to the service
- To remind you of your password or help you create a new one
- To inform you of possible interruptions to the service, upgrades, special offers and new features.
- To provide you with technical support from all pages of the platform, we log technical support requests and use the helpscout.com service to manage them
- For better quality and significantly higher success rates when sending documents to your customers, we use the postmarkapp.com service
Billit O.E. will disclose personal data of its customers, without informing them in advance, only if this is required by law or in good faith (a) in order to comply with relevant orders or legal proceedings, (b) to protect its commercial interests and its intellectual property rights relating to its services and the site, and (c) to act in emergencies in order to protect the personal safety of the operators of its services, the operators of the site or the public.
Control of personal data
When you register as a subscriber to a service, or in any other way give us personal data, Billit O.E. will not share this data with any third party without your permission, except for the exceptions mentioned above. Your data will be used for the purposes already mentioned.
Billit O.E. reserves the right to send periodic emails informing you about technical or other matters relating to the services provided or the services to which you have subscribed. You have the option not to receive these emails.
14. Termination of the Agreement
Billit O.E. reserves the right to terminate this Agreement in the event of non-compliance with the terms of use of the application. If the Subscriber breaches the terms of Articles 5 or 6 of this Agreement, Billit O.E. reserves the exclusive right to terminate this Agreement and/or discontinue the Subscriber’s access to the Service immediately, without specific notice to the Subscriber. If the Subscriber breaches any other term of this Agreement, Billit O.E. may either address a request for compliance to the Subscriber or terminate the Agreement or discontinue the Subscriber’s access to the Service, after giving the Subscriber written notice 15 days before the discontinuation.
In that case, Billit O.E. will not be liable to the Subscriber or any third party for the discontinuation of the Service. Termination of this Agreement does not mean that the Subscriber is released from paying any outstanding amounts owed. Billit O.E. reserves the right, after 30 days or more have passed since the termination, or the dissolution or expiry in any way, of this Agreement, to delete the Subscriber Data from its system. The terms of Articles 1, 6, 7, 9, 10, 14 and 15 will survive the termination, or the dissolution or expiry in any way, of this Agreement.
15. Miscellaneous
- The Subscriber agrees to comply with the applicable export legislation and not to transfer, by electronic transmission or otherwise, data or software subject to restrictions to destinations prohibited under the legislation, without lawful authorization from the competent authority.
- This Agreement does not imply the creation of any commercial relationship or cooperation, such as, by way of example, agency, employment relationship or any other form of related cooperation or relationship between the Subscriber and Billit O.E., beyond that set out in the Registration Form.
- No assignment. The rights and obligations of the Subscriber arising from this Agreement may not be assigned to any third party without the written consent of Billit O.E.
- If any term of this Agreement is held to be unlawful or invalid, it shall be amended or deleted accordingly. The remaining terms of the Agreement will continue to apply.
- Jurisdiction. This Agreement is subject to the exclusive jurisdiction of the courts of Athens.
- Force majeure. Any delay or inability of either contracting party to fulfil its obligations on time (other than financial obligations) due to a proven event of force majeure will not constitute grounds for termination of the Agreement.
- Entire agreement. This text constitutes the entire agreement between the contracting parties and supersedes any prior written or oral agreement, understanding or negotiation between them. This Agreement may be amended only in writing.
- Communications. All documents or written texts permitted or required under this Agreement will be sent by email, fax or mail (express or registered) to the respective addresses most recently notified.

16. Refund / Cancellation Policy
With regard to the subscriptions provided by Billit O.E through the Billit.io service, if the customer decides to cancel within 14 days, the amount paid is refunded in full upon request, whether it is a monthly or an annual subscription. After the 14-day period, 50% of the total is refunded.
With regard to services provided by Billit O.E. that do not relate to the Billit.io subscription service, through payment orders (OCP LINKS) or documents, where the service is delivered in full and invoiced afterwards, no amount is refunded. If it is an advance payment for a service, no amount is refunded either. If, however, the service provided has been paid in full but both parties agree that the provision of the service has not been completed, upon request, compensation of up to 50% of the total may be refunded, depending on the progress that has been achieved.
17. Service Delivery Policy
The service is activated immediately once the customer selects a subscription and makes a payment. If any problem arises during the renewal of the service, please contact us at our support email, and within 60 minutes the account will be back in the state it should be in.
18. Payment Methods / Transaction Security
The service provided by billit.io uses Everypay as the payment institution that handles its credit card and electronic payments. Recognizing the importance of electronic payment security, EveryPay is a Payment Institution licensed by the Bank of Greece (decision no. 280/3/23-7-2018, Government Gazette (FEK) B 3010/25-7-2018), and securely handles card payment transaction data in accordance with the regulatory framework of the card transaction security management standard. Everypay is certified under the card transaction security management standard (PCIDSS).
All Everypay services are carried out over secure connections with 256-bit SSL certificates. EveryPay also supports the use of the 3D Secure service, an additional security safeguard for VISA, MasterCard, Maestro, Diners & Discover cards. The Payer must then enter their personal secret code in order to complete the transaction successfully.
In addition, the service provided by billit.io also uses Stripe as a payment institution for handling credit card and electronic payments. Stripe is certified under the card transaction security management standard (PCI-DSS) at the highest level (Level 1 Service Provider). All transactions are carried out over secure encrypted connections (TLS/SSL) and 3D Secure authentication is supported, an additional security safeguard for VISA, MasterCard, Maestro, American Express, Diners & Discover cards.
